Speaker Lab Terms of Service

Welcome to Speaker Lab, an AI-powered public speaking coaching platform owned and operated by Shil Shanghavi. By subscribing to and using Speaker Lab, you agree to the following Terms of Service. Please read them carefully.

For the purposes of these Terms of Service, references to “Speaker Lab” include both the platform and Shil Shanghavi as its owner and operator.

1. Acceptance of Terms

By accessing or using Speaker Lab, you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform.

2. Subscription and Payment

a. Free Trial

  • Speaker Lab offers a 7-day free trial for new users.
  • After the trial period, users will be automatically charged for an annual subscription unless canceled before the trial ends.

b. Annual Subscription

  • The subscription fee is billed annually in advance.
  • Payments are non-refundable, except as required by applicable consumer protection laws.
  • Users are responsible for canceling their subscription before renewal if they do not wish to continue.

3. Platform Hosting and Third-Party Terms

  • Speaker Lab is hosted on Yoodli’s platform. By using Speaker Lab, you also agree to Yoodli’s Terms of Service (Yoodli T&Cs).
  • Any issues related to Yoodli’s service, data processing, or platform functionality fall under Yoodli’s responsibility.

4. User Responsibilities

  • Users must be at least 18 years old or have parental consent.
  • Users must not misuse the platform, engage in unlawful activities, or attempt to interfere with the AI system.
  • Speaker Lab reserves the right to suspend or terminate access for violations of these terms.

5. Intellectual Property

  • All content provided by Speaker Lab, including AI-generated feedback, remains the property of Speaker Lab.
  • Users may not copy, distribute, or reproduce content without permission.

6. Limitation of Liability

  • Speaker Lab provides AI-driven coaching but does not guarantee specific results.
  • The platform is provided “as is” without warranties of any kind.
  • Speaker Lab is not liable for any damages arising from the use or inability to use the platform.

7. Privacy and Data Usage

  • Speaker Lab collects and processes user data in accordance with its Privacy Policy.
  • Users consent to the processing of their data for AI analysis and feedback purposes.
  • For Australian users, Speaker Lab complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
  • For EU users, Speaker Lab complies with the General Data Protection Regulation (GDPR).
  • For California-based users, Speaker Lab complies with the California Consumer Privacy Act (CCPA).

8. Consumer Rights & Refund Policy

  • Australian users are entitled to rights under the Australian Consumer Law (ACL), including remedies for faulty services.
  • EU users have rights under GDPR and consumer protection directives.
  • U.S. users are subject to relevant state and federal consumer laws.
  • Refunds will be processed in accordance with applicable consumer protection laws based on the user’s jurisdiction.

9. Cancellation and Termination

  • Users can cancel their subscription at any time via their account settings.
  • Cancellations take effect at the end of the current billing period – annual subscriptions will remain active between the date of cancellation and the expiry of the subscription period. 
  • No pro-rata cancellations or refunds are permitted.
  • Speaker Lab reserves the right to terminate accounts for violations of these terms. Refunds are not permitted where cancellation has occured due to the violation of these Terms of Service. 

10. Governing Law & Jurisdiction

  • For Australian users, these Terms of Service are governed by the laws of Australia, and disputes will be resolved in Australian courts.
  • For international users, these Terms of Service shall be governed by the laws applicable in the user’s jurisdiction, where mandatory local laws apply.
  • Any disputes shall be resolved through binding arbitration or in courts located in the user’s jurisdiction where required by law.
